The Operation of Adjudication and Litigation in Construction Disputes in the UK

Abstract

This article observes the recent operation of Alternative Dispute Resolution, in the form of Adjudication, and Litigation in the civil courts in deciding construction disputes in the UK, including: (i) recent cases in the Technology and Construction Court of the High Court where building contractors have sought enforcement of Adjudicators’ decisions by way of Summary Judgment, (ii) the circumstances in which the Technology and Construction court will grant a stay of enforcement, (iii) a review of some recent decisions in construction Adjudications upon jurisdiction of the Adjudicator,
